To Mr Wm Radley at Greenwich



Sir

      I recd yours 4th 5th Aug Inst wth a Copy of the Case relating the Intrusions into High Stublick Colliery, & the Attorney Generals opinion thereon upon wch Mr Boag and I have had a Consultation with Mr Airey, who is of Opinion as we are that it is most proper to file an Information  on the Equity Side of the Court of Exchqr. for an Accot. of what Coales have been wrought , & for an Injunction to stay their working as the Attorney General Advises, for as the other way of proceeding will take up to Long a time the <Ten.t> will be thereby a great sufferer, & we are in hopes that a stop being putt to the working may put an End to the Dispute as it is not of very great Consequence to Mr Blackett.

	You Desire to know in what manner Dilston, Whitley, Coastley, Throckley, & Newlands Mills stands, & whether the penalty of 40s on the Ten<an>t’s default to grind at the Respective Mills in their Leases mentioned, may Continue in the Leases to be filld up as they are printed. In Answer to wch Dilston Mill is within the Manor of Corbridge, wch Manor belongs to the Duke of Somerset, Whitley & Coastley Mills are within the Manor of Hexham wch Manor belongs to Walter Blackett esqr., Throckley Mill is in the Manor of Throckley belonging to the Comm<ission>ers of Greenwich Hosp. & the Mill at Newlands is within the Manour of Newlands & Whittonstal belonging also to the Commrs of Greenwich Hosp. You will therefore observe that all these mills are a pt. of the D<erwentwat>er estates but the Manors in wch Dilston Whitley & Coastley Mills are doe not belong the D<erwentwat>er Estate you will judge how farr the words in the printed Leases relating the penalty are liable to Alteration as the Circumstance is, but in all the Leases every Tent. must be Liable to a penalty of 40s in Case he or they doe not grind at the Respective Mills they Covenant to grind at.
