To Messrs. Boreham & Douglass in Newcas. 21st March 1771 Berwick upon Tweed Gentlemen Sir Walter Blackett having taken the Opinions of Eminent Council upon the Article signed by you & delivered at Wallington of your Intention of quitting his Colliery at Unthank on the 1st of Janry next bids me acquaint you that he is advised he cannot with Safety accept the Surrender of the Lease therof without the Consent in Writing under the hands of the Assignees of the Estate of Mr Stow who was a joint Lessee with you and is since become a Bankrupt; And Sir Walter is further advised that notwithstanding your said Notice he can Compel you to hold the said Colliery to the End of the Twelfth year of your Term; because the said Notice is void as it is not signed by the Assignees of Stow the Bankrupt who are intitled to a third part of the Lease. Ad that you two will continue liable to the Payment of the Rent and performances of the Covenants on the part of the Lessees. However if you can before the Expiration of two Months from the Date of this Letter procure the Assignees of Mr Stow to sign a Notice to Him requesting that he will accept It as if it had been given in time and that he will be pleased to make the Lease void pursuant to the Notice given by you I am inclined to think Sir Walter may be prevailed upon to so do.
