Letter – Henry Richmond to Edward Fairless – 29 Oct 1765

In Bishop Auckland                                                             Newcas[tle] 29th October 1765



Sir       As I do not chuse to engage in the disputes which I find the division of Keenley Comon is likely to be productive of, I must desire to change the plan upon which I will consent to a division, & substitute the following terms viz



Not to be at any Expence whatsoever

To have no hand in passing the Act of Parliament

To have a reasonable sum for my present tithe barn, & a proper place for Building another

To have, in lieu of the sixteenth, an Annual rent of fourpence an Acre for so much of the Comon as shall be divided.

To have the allotments titheable from the date of the award.

To have a sufficient quantity of the Comon left for freestone and Limestone quarries for my use and for the copyholders; provided they do not sell any stone, nor erect any drawkilns.

Not to be liable to damages on working my Royalties in any case; except I should work freestone or Limestone quarries in any of the Allotments: and then I shall agree to make reasonable satisfaction for spoil of ground occasioned thereby.

These terms I desire you will communicate to the Gentlemen concerned and am etc
