                         in Berwick upon Tweed

Sir

  I wrote you on the 20th Augst. last that Sir Walter Blackett desired you would examine whether the Road thro’ Unthank Middle -Ord & West Ord towards Scotland is a Public or a private Road - but have not yet received any Accotof your Success particularly as to Mr Pringle of Akeld’s Testimony.  the Season of the Year will scarce allow you now to make any Progress in the Inquiry, but as soon as you can you will please to do something in it.  For Mr. Douglass, who undertook the Repair of this Road in April 1767 when he was a Lessee of Unthank Collry. upon a presumption I suppose of its being a Private Road, that might be confined to the Use of that Colliery did actually repair a part of it that Year tho’ very insufficiently; & then dropt any further proceeding in it   But now that he is become a Lessee of Scremerston Colliery adjoining  he wants this Road to be a public one & put into repair at Sir Walter‘s Expence under the said agreement in 1767, which he is now proposing to carry into Execution.

  On the other Side you have an extract of the Clause in Mr Douglass & partners Lease of Unthank Colliery that relates to this Road & a Copy of Mr. Geo: Douglasses agreement drawn by you for the repairing it.  When you have compared these with such Testimonies as you have taken about the nature of the Road you may perhaps be able to tell me what I should say in Answer to Mr. Douglasses declared Intention of repairing the Road under that Agreement; & Sir Wr desires you will favour me with your Sentimentt about it.  If this Road can be maintained to be a private one perhaps the same reason may still subsist for repairing it that induced

Mr. Robson to stipulate for it when he let the Colliery to Mr. Douglass & partners.  I am etc
