The inclosed three papers were brought to me at Wallington by Mr John Wallis of Westgate; and I desire you will return them to him with your own hand and at the same time give him the following Answer as to the demand of damages for working in East Black Dean pasture viz That it appears by an Examination of old Witnesses upon Oath One hundred and Thirty Years ago that the Moor masters had had, for time immemorial, a right of working the Leadmines in any of the Wastes, Fells or stinted pastures in Weardale without making any Satisfaction for damages done thereby. this power of Moor Master I hold by Lease under the Bishop of Durham & Black Dean pasture falls within the Description of the exemption and therefore I shall not pay damages for working in that pasture.
