Letter – Henry Richmond to Walter Blackett – 5 Aug 1769

Inclosed is a Copy of Dr Blackstones Opinion on the four Queries in the Case about the Tithes of Wallington, Rothley etc claimed by Greenwich Hospital. The opinion is much in your favour; but Mr Yorks, Mr Dunnings, & Mr Fawcetts are to be had before a Judgement can be formed.

Mr Walton told me to day he found they should have a dispute with You about the Suit to your Court at Hexham; as he found a distress had been made on one of their Tenants for not appearing: which the Com[missione]rs were determined of Supporting them in. I did not know any Thing of this Step being taken: but thought, as you ordered, it was to rest till you went again to London, & had further Advice about it. The opinions taken on this Case are Mr Rivetts Mr Fawcetts and Mr Wilson’s; & they all agree that the Tenants of the hospital are liable to appear at the Court Leet, and may be amerced for their default. Mr Fawcett advises bringing Actions for such Amercements – the others are for distraining. Mr Walton says he has orders to pay £20 being the hospitals Contribution for Warden Church. I am etc    HR
