Mr Darwin No 4 Hatton Street London Newcas 24th May 1774 Sir The Query that Mr Duane has made respecting the Quarries in that part of the Town[shi]p of East Ord called Middle Ord, and what you say about it, is certainly right - for Sir Walter should not convey away the Quarries in his own Estates - Mr Selby bought only the Coalmines in the Town[shi]p of East Ord and Sr Wr afterwards voluntarily added the Leadmines & Quarries to the purchase but that Gift must not be taken in so large extent as to be prejudicial to Sr Wrs own Estate at Middle Ord therefore there must be an Exception inserted in the Deed securing the Quarries in Middle Ord to Sir Walter As to the Leadmines and Quarries in the Threap Ground they are intended to be conveyed to Mr Selby according to the Right Sir Walter has in them, namely, As Lord of the Manor as to two fifths of the Mines of Lead and Coal and Quarries of Stone and as purchaser of Mr Lisle as to three fifths of the Coal only but as to these three fifths you will please to see the Copy of the purchase Deed which I sent you and take care that Sr Wr conveys in no other Terms nor with any other powers of working than are contained in that Deed You will please to attend to the little difficulty that may arise about this Threap Ground and Colliery etc - Sir Walter has One third of the Ground he has after also two fifths of of the Colliery and Leadmines and Quarries of Stone and or that Ground and this he has under the Title derived from his Lady - he also has the remaining three fifths of the Colliery (and you will please to observe it is only of the Colliery) as purchaser of Mr Lisle I am etc HR
